NAPH, Others Urge Solicitor General to File Amicus Brief in Supreme Court Medicaid Case - March 23, 2011

On March 21, 12 organizations, including NAPH, submitted a letter to the United States Solicitor General, urging the federal government to file an amicus brief in support of the health care providers in consolidated Medicaid cases pending before the U.S. Supreme Court. The cases, including Douglas (formerly Maxwell-Jolly) v. Independent Living Center of Southern California, Inc., et al., address the question of whether Medicaid recipients and providers may sue states to ensure compliance with the federal Medicaid statute under the Supremacy Clause. At stake is a proposed 10% reduction in Medi-Cal payments to health care providers in California, but a ruling against Medicaid recipients and providers could have repercussions on the Medicaid program nationwide.
