NAPH leads coalition letter on Medical lawsuit - August 11, 2010

On Friday, August 6, NAPH led a coalition of 15 national organizations to send a letter to the Solicitor General urging that the United States Supreme Court not consider arguments in Maxwell-Jolley v. Independent Living Center of Southern California, a case involving the ability of providers and beneficiaries to challenge in federal court rate cuts imposed by states. The Supreme Court has invited the federal government to weigh in on whether the Court should hear the case. NAPH understand that a number of states submitted a letter to the Solicitor General urging him to favor review. Because the lower courts ruled in favor of the providers and beneficiaries, NAPH and the other signatory associations believe that the Supreme Court should not review this case. In addition to NAPH, signatories include the American Academy of Pediatrics, American Hospital Association, National Association of Community Health Centers and other provider groups.
