CMS Withdraws Proposed Medicaid Rehabilitative Services Rule - November 24, 2009
CMS has withdrawn its August 13, 2007 proposed Medicaid Rehabilitative Services Rule, which proposed to clarify the definition of, and establish new documentation and other requirements for, Medicaid rehabilitative services. Like the Medicaid Public Provider Cost Limit and Graduate Medical Education rules, the proposed Rehabilitative Services Rule was subject to two congressional moratoria, the most recent of which expired on April 1, 2009, and a Sense of the Congress Resolution that the Secretary of HHS should not finalize the rule. Citing "clear congressional concern as well as the complexity of the underlying issues and public comments received," CMS decided to withdraw the proposed rule effective November 23, 2009. CMS has not taken any action regarding the proposed Medicaid Public Provider Cost Limit or Graduate Medical Education rules, which NAPH does not expect the agency to finalize.
