CMS Issues Final Rule on Medicaid Program Premiums and Cost Sharing - June 9, 2010

On May 28, the Centers for Medicare and Medicaid Services issued a revised final rule with comment period providing new state flexibility to impose Medicaid premiums and cost sharing for coverage of certain individuals. CMS amended the original rule, which was first published on February 28, 2008, and later delayed by the Obama Administration, to reflect additional comments and to incorporate an exemption included in the American Recovery and Reinvestment Act (ARRA) for certain services provided by or under contract with the Indian Health Service. The revised final rule takes effect July 1, with comments on implementation of the ARRA-related provisions due July 27.
